By submitting an application, you agree to and acknowledge the following:
- Application: All applicants must ensure all information submitted is true and accurate to the best of their abilities. Any applicants that fail to provide requested information (either on the application or via follow-up communication from BLB Resources) shall be deemed non-compliant and their application will be rejected.
- No Guarantee: Please note that submission of this application does not guarantee you will be added to our network of LLBs. In addition, you acknowledge that BLB Resources has not made any representations as to the estimated or actual minimum or maximum number of Properties that may be assigned to applicant if added to our network, that you are not relying on receiving any minimum number of Properties, and that there is no guarantee as to any minimum number of Properties that may be assigned to you by BLB Resources.
- Service Areas: BLB Resources will select the appropriate number of LLBs to perform services in the HUD regional contract areas that have been assigned to BLB Resources. Multiple LLBs may be contracted to perform services in any given area.
- Vendor Selection: BLB Resources reserves the right to determine and apply the criteria for selecting LLBs, to decide an appropriate number of LLBs, and to assign corresponding coverage areas. When evaluating potential vendors to add to our network, we consider numerous factors and give preference to small businesses, especially veteran owned, service disabled veteran owned, 8(a), small disadvantaged owned, minority owned, and woman owned businesses.
- Privacy: By submitting an application, you are providing information to us, which we will review as part of our process of determining whether to add an applicant to our network. We evaluate many factors during this process and retain all applications in our database. We do not sell or share your application data except as required or permitted by law (for example, providing access to your application to our employees in the course of our normal business is a permitted disclosure of your application data). In all situations, we emphasize the importance of confidentiality.
- Vendor Agreement: If you are selected to join our LLB network, you will be required to sign and abide by a vendor agreement and scope of work. Links to the executed scope of work, and any other necessary addenda/training material will be provided to the selected vendor at time of approval; however, key clauses are summarized below. Please note that the required scope of work may be modified at the discretion of BLB Resources in compliance with HUD requirements and/or BLB Resources procedure changes. The most current agreement, scope of work, and other relevant documents will be available via links when logged into the Vendor portal of the BLB Resources website.
- Gratuities/Kickbacks/Ethical Conduct: BLB Resources, Inc. complies with FAR 52.203-7 Anti-Kickback Procedures, and expects full compliance with this clause from all vendors.
- Conflict of Interest: Vendor shall not engage in any transaction or activity that would create any conflict of interest regarding the vendor agreement or the listing or sale of the properties. Prohibited activities includes, but is not limited to:
- Making warranties or representations of any kind concerning property condition that is outside the scope of the Appraisal performed under agreement with BLB Resources;
- Receiving or paying any type of referral fee as a result of referring buyers from calls initiated on properties, or from providing any type of information related to a property covered by this Agreement;
- Directly or indirectly acquiring any interest in any HUD-owned properties;
- Undertaking any or all activities that would create, or have the potential to create, a conflict of interest with BLB Resources or HUD,including but not limited to LLB acting as a mortgage broker or lender on any HUD-owned properties, person or entity functioning as multiple different vendors for BLB Resources (e.g.,. as both appraiser and LLB), directing buyers and/or selling agents to specific outside vendors (e.g., LLB directing buyers to one specific lender or title insurance company, unless LLB is also acting as the selling agent, i.e. dually representing both HUD/BLB Resources and the buyer), etc.;
- Directly or indirectly charging any type of fee (e.g., transaction, storage, broker administration, coordination, or any other similar selling agent fees) to the buyer on the selling side of a HUD-owned property; or
- Negotiating or executing HUD Home Sales Contracts on Seller’s behalf, or any other documents which purport to bind Seller. No provisions herein constitute such consent.
- Insurance: BLB Resources requires all vendors to maintain Errors & Omissions insurance and General Liability insurance. Vendors are independent contractors (not employees of BLB Resources, Inc.) and therefore must also maintain their own Workers Compensation insurance as required by federal/state/local regulation.
- Compliance: Vendor shall comply with all applicable laws, orders, rules, regulations, and ordinances. Vendor shall procure all licenses, permits, qualified labor/personnel, materials, supplies, technical equipment, professional memberships, etc., and pay all fees, dues, and other required charges necessary to conduct its business, all at Vendor’s expense.
- At Will Contract: Vendor acknowledges that this is an "at will" contract and either party to the contract (i.e., Vendor or BLB Resources) may terminate at any time by providing written notice to the other party. If terminated by BLB Resources, Vendor will not receive any further assignments but may be required to complete any outstanding assignments.
- Release of Claims: Vendor hereby expressly releases and forever discharges BLB Resources, the Secretary of HUD, and HUD's past, present or future employees, agents, attorneys, representatives, and all other person(s) and entities acting for or on behalf of BLB Resources and HUD, from any and all conduct, claims, and demands, damages, injuries, grievances, charges, actions or cause of action, known or unknown, either at law or in equity, which Vendor may have arising out of or in any way relating to any such issue.
- LLB Scope of Work
(Please note the following is a brief outline of major responsibilities and specific duties, procedures, etc. are detailed in the Scope of Work provided with the Vendor Agreement upon selection to join our network):
- Maintain valid NAID and state real estate license
- Conduct inspections
- Three (3) HUD required Asset Manager (AM) inspections
- Routine inspections
- Any other inspections upon request
- Report property preservation issues
- Marketing Photos
- BPO Reports
- At initial inspection or any time thereafter
- May also be requested to complete gratis third-party BPOs on properties assigned to other LLBs
- Property Info Verification, including but not limited to the following:
- HOA contact and fee info
- Water and sewer type
- Crawlspace/attic
- State/local laws, regulations, ordinances, point of sale inspections, etc.
- Listing Properties
- Determine appropriate MLS board(s) in which to feature each listing
- If in area served by multiple MLS boards, may be required to input listings in all MLS boards
- If no MLS exists, LLB must provide a comprehensive alternative marketing plan to ensure property is appropriately advertised
- Update listing info as necessary
- Upload marketing photos and listing disclosure addenda
- Signage and Lockbox Procedures
- Conduct advertising, marketing, and outreach appropriate to each property/market area and submit monthly summary reports
- All advertising, marketing, and outreach efforts must be in compliance with the requirements of BLB Resources as well as all applicable federal, state, and local laws and regulations including but not limited to the Equal Credit Opportunity Act, the Fair Housing Act, and Federal Criminal Statute 18 U.S.C. § 709, 'False advertising or misuse of names to indicate Federal agency'
- Conduct regular outreach/training events for buyers, real estate professionals, and lenders
- May be required to develop alternative marketing strategies for aged inventory in addition to normal marketing strategy(ies)
- Provide excellent customer service at all times to all parties
- LLBs are an extension of our company and HUD and therefore shall be courteous, helpful, knowledgeable, and responsive to other agents, lenders, vendors, HUD representatives, and the public in general
- Retain a full time staff dedicated to the HUD account, working a minimum of 8 hours per day, 7 days per week
- Attend all training events as directed by BLB Resources and/or HUD
- Various additional miscellaneous tasks/duties
